MALIBU ENCINAL HOMEOWNERS ASSOCIATION
Whether you purchased a home or lot you are now an “official member” of the Malibu Encinal Homeowner Association. This Association is responsible for the maintenance, improvement and replacement of common area components, such as streets within the complex, landscaping, gates, etc. The monthly assessment you pay to the Association is allocated between the monthly operating expenses and the reserve fund, which is for long-term replacements and improvements. The amount of the quarterly assessment is based upon a budget which the Malibu Encinal HOA Board of Directors prepares and presents to the membership prior to each year’s fiscal year. The Association has a fiscal year end of August 31. From the day your deed is recorded, the association assessments are due.

GATE ACCESS
To enter the Malibu Encinal HOA vehicle gate, you will need a remote that you either received from the previous owner, or has been issued by the management company. Your phone line can be linked to the gate phone, and an individual number will be assigned. If you wish, your name can be posted in the directory at the gate phone so that guests can call you to open the gate for them, which you can do from your touch tone phone. There is a small service charge for the set up and gate cards. Please call Management for details.
PARKING
There are a limited number of parking available. Most lots and homes no outside street side parking spaces and guest and contractor parking is limited. For more information, contact your management company. All assigned parking spaces may not be used by anyone other than the unit owners without permission.
PETS
All pets must be on a leash when outside of your unit. No exceptions. It is very important that pet rules be respected for the safety and convenience of all residents of the community.
BOARD OF DIRECTORS
The Associations’ Board of Directors are composed of eleven members who were elected by the entire membership at their annual meeting. All necessary documents regarding the annual membership meeting will be mailed to you in a timely manner. Each Director serves a term of one year. The Board of Directors acts on behalf of the membership with the goal of making ownership in both associations more pleasant and harmonious. The job is voluntary and without compensation. The Malibu Encinal HOA Board meetings are usually held monthly, and all homeowners interested in association affairs are welcome to attend. Only Board members can vote on matters - not the attending homeowners. An “open forum” is usually part of each meeting, and a limited time is allocated to give owners the opportunity to address their issues and concerns.
MANAGEMENT
Real Support Property Management is your Association’s managing agent. Our firm has provided services for Homeowners Associations for many years. Our helpful and qualified staff will know you in very short time and will assist you with your questions, comments and problems Our company policy is to have a very close and individual contact with each association and its members. All matters are handled in house: management, accounting, administration, etc. We consider every homeowner important and will certainly assist you in making life in your new home a most pleasurable experience. Our firm collects your assessments, supervises the Association’s banking accounts and financial records, provides all accounting and administrative services, attends Board meetings, and is generally responsible for the
maintenance of both associations.. Management is responsible solely to the Board of Directors and works closely with the individual Board members. Home owners should notify management of any problems or concerns they may have. Management will notify your Board of Directors, and together we try to solve each problem. Any recommendations or suggestions are welcomed, and should be addressed to Real Support.
CC&Rs
The Declaration of Covenants, Conditions and Restrictions (CC&Rs) and Bylaws are the legal governing documents of your Homeowner’s Association. We have provided your escrow company with a bound copy of these documents as well as Articles of Incorporation and Rules and Regulations. Be certain that you have received this package from the escrow company. Read and understand them. They tell what you own as the home or lot owner, and outline your responsibilities to the Association and it responsibilities to you. From the moment you take ownership of your property, you are responsible for its contents. Ask a qualified Realtor or your attorney for an interpretation if you do not understand certain sections. If you have never lived in a Homeowners Association community, you will find it a little different from your previous way of living. Off-site owners should always provide their tenants with a copy of the Rules and Regulations to avoid any behavior or activities for which the owner will be held responsible. Well informed tenants are an asset to the community.
ARCHITECTURAL GUIDELINES
Your Association also has architectural guidelines. Exterior changes to your home or structure must be first approved by the Malibu Encinal HOA. Again, read the enclosed associations’ governing documents very carefully. Our management company is bound by the association’s CC&Rs and architectural guidelines. In the event you are in violation, the Board has the means and duty to enforce the CC&Rs.
ASSOCIATION FINANCES
The Board of Directors receives a monthly financial report, which is prepared by our accounting department. At the year end, you will receive audited financial statements of the associations, prepared by an independent Certified Public Accountant. You will also receive an annual Reserve Study prepared by the Associations’ management company
and approved by the Board of Directors. This report details every common area component that each association is responsible for maintaining, and gives the components estimated life and cost of replacement. The funding for this reserve is included in your monthly assessment.
Assessments are due each month on or before the due date. Although our company mails out statements or coupons, it is your responsibility to pay all assessments on time, even if you do not receive notification.
Section 1366 of the California Civil Code states that, regardless of more restrictive limitations in an association’s documents, the Board may increase regular assessments up to 20% of the previous year’s assessment. The Board may also impose a special assessment that does not exceed 5% of the budgeted expenses. Higher increases are legal if more than 50% of the owners attend a meeting at which a majority of those present approve the increase.
AND FINALLY - LIVING BY THE RULES
Living together in a community like the Encinal Homeowners Association requires minimal agreement on the limits of individual behavior. Rules and Regulations are put in place to ensure that all homeowners, tenants, and guests can enjoy the maximum benefits of your association. The Rules and
Regulations are part of your document package which you received from your escrow company. When an infraction of these rules occurs, the basic procedures outlined in the CC&Rs are as follows: the homeowner will be notified of the problem by a warning notice. On the receipt of a second complaint of the same violation, the homeowner will be issued a second notice with a proposed fine. The homeowner will then be invited to a special Board of Directors meeting to discuss the violation. In severe cases, the matter will be handled through the Association’s legal counsel. The Rules are few and fair, and we encourage you to become familiar with them. |
